application (the "App") and the website at poolplayapp.com (the "Site"). This
Privacy Policy explains what information we collect, how we use and protect it,
and the choices and rights you have.PoolPlay is a points-only social competition app. Members create or join
private "pools," make sports picks, and compete on live leaderboards for points
and bragging rights. Points have no cash value and are for entertainment only.By creating an account or using the App, you agree to the practices described in
this Privacy Policy. If you do not agree, please do not use the App.---1. Information We CollectWe are committed to collecting only what we need to run the App. We do not
collect payment card numbers or bank information — all purchases are handled by
Apple and Google (see Section 4).a. Account & Profile Information
When you create an account, we collect basic profile information, including:- Email address (used to authenticate your account and send essential
service communications)
- Username and display name (shown to other members of your pools)
- An optional avatar or monogram associated with your profileIf you choose to sign in with Apple or Google, we receive basic profile
details (such as your email address and name) from that provider in order to
create and secure your account. We do not receive your Apple or Google password.2. In-App Purchase Transaction Metadata
When you purchase a Pool License, our systems receive transaction
metadata from the App Store or Google Play — such as the product identifier,
a transaction identifier, the store platform, the purchase environment
(sandbox or production), and the transaction status. This metadata is used to
verify your purchase, unlock the associated features, and honor refunds. We do
not receive or store your credit card number, CVV, or bank account details —
those are processed entirely by Apple or Google.c. App Activity
To provide the core experience, we store the content you create in the App, such
as the pools you create or join, the picks you make, your points, and your
standings. This information is visible to the other members of your pools as part
of the social experience.d. Technical & Diagnostic Information
We may collect limited technical information necessary to keep the App secure and
functioning, such as authentication session tokens and basic error diagnostics.---2. How We Use Your InformationWe use the information we collect to:- Create, authenticate, and secure your account
- Provide the core social features — pools, picks, leaderboards, standings,
streaks, and head-to-head comparisons
- Verify in-app purchases and unlock the features associated with a Pool License
- Process and honor refunds initiated through the App Store or Google Play
- Communicate with you about your account, security, and essential service
updates
- Detect, prevent, and address fraud, abuse, and violations of our Terms of
Service
- Comply with our legal obligationsWe do not use your information for third-party advertising, and we do not
build advertising profiles about you.---3. How We Share InformationWe Do Not Sell Your Data
We do not sell your personal data to third parties. We do not share your
personal information with data brokers or advertisers.Within Your Pools
Your username, display name, picks, points, and standings are visible to the
other members of the pools you join. This is a core function of a social
competition app.Service Providers
We share information only with the trusted infrastructure providers that operate
the App on our behalf:- Supabase — provides our secure cloud authentication, database, and session
token management. Your account and app data are stored on Supabase's managed
infrastructure under access controls.
- Apple App Store / Google Play — process all payments and provide the
purchase transaction metadata described in Section 1(b).
- RevenueCat — helps us validate in-app purchase receipts and manage
entitlements across the App Store and Google Play.These providers are contractually bound to protect your information and may use
it only to provide services to us.Legal Requirements
We may disclose information if required to do so by law, or if we believe in good
faith that disclosure is necessary to comply with a legal obligation, protect our
rights, or protect the safety of our users or the public.---4. PaymentsAll purchases in the App — including the $4.99 Pool License — are processed
by Apple (App Store) or Google (Google Play) under their own terms and
privacy policies. We never see or store your full payment card or bank
details. We receive only the transaction metadata needed to verify your
purchase and unlock features, as described in Section 1(b).---5. Data SecurityWe take the protection of your data seriously and apply industry-standard
safeguards, including:- Encryption in transit — all communication between the App and our servers
is protected using TLS/HTTPS encryption.
- Encryption at rest — account and app data stored on our managed Supabase
infrastructure is encrypted at rest.
- Secure authentication — sessions are managed with secure, industry-standard
tokens, and sign-in is handled through Supabase authentication (including
Sign in with Apple and Google). We never store your third-party passwords.
- Access controls — database access is restricted with row-level security so
that members can only access the data they are entitled to see.
- Sensitive store tokens masked — raw purchase receipt tokens are never
exposed to the client application.No method of transmission or storage is 100% secure, but we work continuously to
protect your information using the measures above.---6. Data RetentionWe retain your account and app data for as long as your account is active. When
you delete your account (see Section 7), we remove your personal profile
information and associated app data. We may retain limited transaction records
where necessary to comply with legal, accounting, or fraud-prevention
obligations.---7. Your Rights & Account DeletionYou are in control of your account and your data.Right to Deletion
The App includes a built-in, automated account deletion feature. You can
permanently delete your account at any time from Profile → Delete Account.
When you delete your account:- Your profile information (email, username, display name) is removed
- Your pools membership, picks, and points data are removed or disassociated
- The action is permanent and cannot be undoneWe may retain a minimal record of past transactions where required for legal or
accounting purposes, as noted in Section 6.Access & Correction
You may review and update your profile information directly in the App. If you

Depending on where you live, you may have additional rights under laws such as

the United States, you understand that your information may be transferred to,

These Terms of Service ("Terms") are a binding agreement between you and PoolPlay ("PoolPlay," "we," "us," or "our") and govern your access to and use of the PoolPlay mobile application (the "App"), the website at poolplayapp.com (the "Site"), and all related features and services (collectively, the "Service").Please read these Terms carefully. By creating an account, purchasing a Premium Feature Access setup, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.1. What PoolPlay IsPoolPlay is a points-only social competition and entertainment application. Members track private groups, make sports predictions, and view live leaderboards and social features — including standings, streaks, head-to-head comparisons, field consensus insights, and social boards — for points and bragging rights only.PoolPlay is a game of social entertainment. It is not a betting, gambling, sportsbook, or real-money gaming service, and it does not offer any prizes, payouts, or cash rewards of any kind.2. Eligibility & Age RequirementYou must be at least 17 years of age to create an account or use the Service. By using the Service, you represent and warrant that you are 17 or older and that you have the legal capacity to enter into these Terms. If you are not 17 or older, you may not use the Service. We may terminate any account we reasonably believe to belong to a user under the age of 17.3. AccountsTo use most features of the Service, you must create an account. Premium Feature Access — A Software Utility Fee4.1 Nature of the Fee
Unlocking a custom group tracking pipeline may require a one-time payment for premium status features, priced at $4.99 USD (or the local-currency equivalent set by the app store).Premium Feature Access is a commercial software utility fee. It is paid solely to unlock access to PoolPlay's premium social interactive layers, live data feeds, and points automation matrix — including live leaderboards, streak and "hot/cold" analytics, head-to-head comparisons, field consensus insights, and social boards within a private tracking group.4.2 What the Fee Is Not
For the avoidance of all doubt, the feature payment is strictly a payment for software functionality and access. It is not:an entry fee, buy-in, stake, wager, or antea deposit, contribution to a pot, purse, or prize poola bet or any form of consideration placed on the outcome of any eventredeemable, refundable into cash, or exchangeable for money or anything of value except as required by the applicable app store's refund policyThe fee entitles you only to the software features and access described above.4.3 Payment & Refunds
All purchases are processed by Apple (App Store) or Google (Google Play) under their respective terms. We do not process or store your payment card details. Refund requests are handled in accordance with the policies of the app store through which you made the purchase. Where a refund is granted by the store, the corresponding premium access features may be revoked.4.4 Public Contests
Certain public global tracking feeds may be available at no charge. Free access layers do not include the full suite of premium social group tools associated with a private tracking circle.5. Points Have No Cash ValueThis is a core, non-negotiable term of the Service.Points, standings, streaks, rankings, and any other in-app scoring metrics are provided strictly for entertainment and social competition.Points carry zero cash value, cannot be redeemed, exchanged, or converted into real-world currency, goods, or anything of monetary value.Points do not constitute prizes, winnings, or awards of any kind.Points are non-transferable and exist only as an internal feature of the application code layers.6. Strictly Prohibited Conduct — No Real-Money GamblingYou agree that you will not, under any circumstances, use the Service to facilitate, organize, promote, or conduct any form of real-money gambling, wagering, betting, bookmaking, or side-payouts. Specifically, you may not:Place, accept, broker, or solicit wagers of money or anything of value based on tracking activities within the AppOperate a sportsbook, wagering ring, or bookmaking operation through, alongside, or in connection with the ServiceCollect, pool, hold, distribute, or pay out money, cryptocurrency, or anything of value as a "purse," "pot," "prize," or payout tied to analytics outcomes or leaderboard pointsArrange or execute side-payments, off-platform payouts, or real-money settlements based on points, standings, or results tracked in the AppUse the Service to promote or link to any real-money gambling utilityPoolPlay provides no mechanism for real-money transactions and expressly prohibits it. Points and standings metrics exist purely as an entertainment and social scoring layer. Any attempt to use the Service for real-money gambling is a material breach of these Terms, is undertaken entirely at your own risk and responsibility, and may result in immediate termination of your account and referral to the appropriate authorities where required by law.7. Acceptable UseYou agree not to:Use the Service for any unlawful purpose or in violation of any applicable lawHarass, threaten, defame, or abuse other members, including through social or commentary featuresAttempt to gain unauthorized access to the Service, other user profiles, or our core cloud systemsReverse engineer, decompile, scrape, or interfere with the operation or security configurations of the ServiceUpload malicious code or attempt to disrupt the network infrastructureImpersonate any person or misrepresent your affiliation with any entityCreate accounts by automated means or maintain duplicate accounts to gain an unfair metric advantage8. Intellectual PropertyThe Service, including its software, design, interface arrays, branding, logos, text, and content layouts (excluding custom message context you submit), is owned by PoolPlay and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended, non-commercial target purpose. You retain ownership of the interaction logs you submit, and you grant us a license to host and display that content as necessary to operate the shared social experience interfaces.9. Account TerminationWe may suspend or terminate your account, with or without notice, if we reasonably believe that you have:Violated these Terms, including the prohibitions in Sections 5, 6, and 7Used the Service for real-money wagering or any unlawful external configurationEngaged in fraud, tracking manipulation, or conduct harmful to other members or to PoolPlayUpon termination, your right to use the Service ends immediately. You may also terminate your account at any time by executing a deletion inside the App. Sections that by their nature should survive termination — including Sections 5, 6, 10, 11, and 12 — will survive.10. DisclaimersTHE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any sports stats updates, league lines, or tracking consensus variables presented are fully accurate, complete, or timely. Sports information is provided for entertainment purposes only.11. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, POOLPLAY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND INFRASTRUCTURE SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.IN NO EVENT WILL POOLPLAY'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO POOLPLAY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $10.00.PoolPlay is not responsible or liable for any real-money transactions, side agreements, or wagering activity that any user may attempt in violation of these Terms; any such activity is solely the responsibility of the individuals involved.Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.12. IndemnificationYou agree to indemnify and hold harmless PoolPlay and its officers, directors, employees, and cloud database providers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party — including any real-money wagering transactions or side-payout activity conducted in breach of Section 6.13. Governing Law & DisputesThese Terms are governed by the laws of the United States and the State in which PoolPlay is established, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved on an individual basis, and you waive any right to participate in a class action, to the extent permitted by law.14. Changes to These TermsWe may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice layout windows within the App. Your continued use of the Service after an update constitutes acceptance of the revised Terms.15. Apple & Google App Store TermsYour use of the App is also subject to the applicable app store's terms of service. Where the App is downloaded from the Apple App Store, you acknowledge that these Terms are between you and PoolPlay only, and not with Apple, and that Apple is not responsible for the App or its structural interface modules.
